These terms govern your use of the MechanicX application and website. They are app-owned content and not legal advice. By creating an account or using MechanicX you agree to them. Questions: admin@mechanicx.co.uk.
Who we are and who these terms cover
MechanicX provides hosted garage management software to UK workshops. In these terms, "we"/"us" means MechanicX, and "you" means the business that holds the subscription (the "garage") together with every user who signs in under that business's account. The person who creates the account confirms they are authorised to accept these terms on behalf of the business.
Accounts and eligibility
- MechanicX is offered to businesses in the United Kingdom. Sign-ups from outside the UK may be refused.
- You must provide accurate company and contact details and keep your accounts email up to date, because billing documents are sent there.
- You are responsible for every action taken under your users' logins. Keep passwords private, use multi-factor authentication where offered, and remove staff accounts promptly when someone leaves.
- We may refuse, suspend, or close accounts that use disposable or anonymised email domains, or where we reasonably suspect fraud or abuse.
Subscriptions, plans and billing
- Subscriptions are billed in advance on a recurring basis through Stripe. Prices are shown in the app and exclude VAT unless stated otherwise.
- Plans differ in features and limits. Some features are only available on higher plans and may change as the product develops.
- You can cancel at any time. Cancellation takes effect at the end of the current billing period; we do not refund part-used periods unless required by law.
- If a payment fails we may retry it and restrict access until the balance is settled. Invoices are emailed to your accounts email and downloadable in the app.
- We may change pricing with reasonable notice before your next renewal.
Credits and metered features
Some features consume credits (for example vehicle data lookups, SMS messages and AI assistance). Credits are prepaid or auto-topped-up, are consumed as used, are non-refundable and are not exchangeable for cash. Credit costs per action are displayed in the app and may be adjusted; material changes will be shown before they take effect.
Acceptable use
- Do not use MechanicX unlawfully, to store data you have no right to hold, or to send unsolicited marketing.
- Do not attempt to bypass access controls, probe other tenants' data, scrape the service, resell access, or reverse engineer the platform.
- Do not upload malware or content that is unlawful, defamatory or infringing.
- Automated or excessive use that degrades the service for others may be rate limited or suspended.
Your data
You keep ownership of the records you create in MechanicX (customers, vehicles, bookings, job cards, estimates, invoices, stock and attachments). For that data you are the data controller and we act as your processor. We use it to operate the service, and otherwise as set out in our Privacy Policy. Export tools are provided in the app; after an account closes, data is retained only for the period described in the Privacy Policy and then deleted.
Third-party integrations
MechanicX can connect to third-party services such as Stripe for payments, Xero for accounting, vehicle and MOT data providers, parts suppliers and messaging providers. When you enable an integration you authorise us to exchange the relevant data with that provider on your instruction. Those services are governed by their own terms, and we are not responsible for their availability, accuracy or pricing. Accounting postings you push to a connected ledger remain your responsibility to review.
Professional responsibility
MechanicX is an administrative tool. Vehicle data, MOT records, service schedules, checklists and AI-generated diagnostic suggestions are aids only. They do not replace the judgement of a qualified technician, and you remain responsible for the work you carry out, the documents you issue and your regulatory obligations.
Availability and support
We aim for high availability but do not guarantee uninterrupted service. Maintenance, provider outages and emergency security work may cause downtime. Support is provided by email during UK business hours.
Intellectual property
MechanicX® is a registered trademark. The software, design, documentation and site content are owned by us and licensed to you for the duration of your subscription for internal business use only. No other rights are granted.
Suspension and termination
You may close your account at any time. We may suspend or terminate access if you breach these terms, if payment fails and remains unpaid, or if required by law. We will give reasonable notice where practical and allow you to export your data unless prevented by legal or security reasons.
Liability
Nothing in these terms limits liability that cannot lawfully be limited. Subject to that, we are not liable for lost profits, lost business, loss of goodwill or indirect or consequential loss, and our total liability in any twelve-month period is limited to the subscription fees you paid in that period. The service is provided without warranties beyond those implied by law.
Changes to these terms
We may update these terms as the product and legal landscape change. Material changes will be notified in-app or by email before they take effect. Continuing to use MechanicX after that means you accept the updated terms.
Governing law
These terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction.
